NOTICE OF APPLICATION IN TERMS OF SECTION 24G OF NEMA FOR THE COMMENCEMENT OR CONTINUATION OF ACTIVITIES IDENTIFIED IN TERMS OF THE 2014 ENVIRONMENTAL IMPACT ASSESSMENT REGULATIONS (AS AMENDED) WITHOUT THE NECESSARY ENVIRONMENTAL AUTHORISATION
Notice is hereby given in terms of Section 24(G), read together with sections 24(F), of the National Environmental Management Act No. 107 of 1998 (“NEMA”) that Overnight Logistics (Pty) Ltd is submitting an application for ex-post-facto approval in terms of Sections 24(G) and 24(F) of NEMA for the commencement of listed activities for the infilling of more than 5m3 of material into a watercourse and the removal of more than 1 Hectare of indigenous vegetation in Alrode, Ekurhuleni Metropolitan Municipality, Gauteng Province without the necessary Environmental Authorisation.
The applicable legislative provision contravened is:
GN. R. 544 of 02 August 2010, Activity 18: “The infilling or depositing of any material of more than 5 cubic metres into, or the dredging, excavation, removal or moving of soil, sand, shells from (i) a watercourse, (ii) the sea; (iii) the seashore; (iv) the littoral active zone, an estuary etc. but excluding where such infilling, depositing, dredging, excavation, removal or moving (i) is for maintenance purposes undertaken in accordance with a management plan agreed to by the relevant environmental authority; or (ii) occurs behind the development setback line.”
GN. R. 544 of 02 August 2010, Activity 23: “The transformation of undeveloped, vacant or derelict land to- (i) residential, retail, commercial, recreational, industrial or institutional use, inside an urban area, and where the total area to be transformed is 5 Hectares or more, but less than 20 hectares.”
